Designation and Relevant Activity Guidelines for the purposes of administrative charging - Final Statement

Summary

This Statement accompanies the withdrawal and making today of a designation pursuant to section 34 and 38 of the Communications Act 2003 (the “Act”) (the “designation”) and publication of guidelines entitled “The definition of “relevant activity” for the purposes of administrative charges” (the “guidelines”).

1. The designation and the guidelines are reproduced at Annex 1 and Annex 2 respectively of this final statement for ease of reference.
2. Publication follows public consultations by the Office of Communications (“Ofcom”) on the designation under section 38(11) and section 34(1) of the Act. At the same time, Ofcom also consulted publicly on the guidelines.
3. Ofcom has also consulted with the Secretary of State on the withdrawal and making of the designation as required under section 38(11) and 34(2) of the Act.
